Landowners fight eminent domain in Pa. gas field (AP)

LAPORTE, Pa. ? When federal regulators approved a 39-mile natural gas pipeline through northern Pennsylvania's pristine Endless Mountains, they cited the operator's assurances that it would make sparing use of eminent domain as it negotiated with more than 150 property owners along the pipeline's route.

Yet a few days after winning approval for its $250 million MARC 1 pipeline in the heart of the giant Marcellus Shale gas field, the company began condemnation proceedings against nearly half of the landowners ? undercutting part of the Federal Energy Regulatory Commission's approval rationale and angering landowners.

Some of the landowners are now fighting the company in court, complaining that Central New York Oil and Gas Company LLC steamrolled them by refusing to negotiate in good faith on monetary compensation and the pipeline's location. Their attorneys say CNYOG has skirted Pennsylvania's eminent domain rules.

The company, a subsidiary of Inergy LP of Kansas City, Mo., insists it's trying to reach a "fair settlement" with all property owners and wants to be a good neighbor.

The dispute could foreshadow eminent domain battles to come as more pipelines are approved and built to carry shale gas to market in states like Pennsylvania, New York and Ohio.

The company promotes the MARC 1 pipeline as key infrastructure in developing the Marcellus Shale, a rock formation underneath Pennsylvania and surrounding states that experts believe holds the nation's largest reservoir of gas. The MARC 1, a high-pressure steel pipeline 30 inches in diameter, will connect to major interstate pipelines and the company's own natural gas storage facility in southern New York state.

CNYOG hopes to start construction soon and finish by July, but it awaits permits from Pennsylvania environmental regulators and the U.S. Army Corps of Engineers.

It also needs to answer the legal challenge from residents.

Many of the complaining landowners say they favor natural gas drilling and some have leased land to gas drillers. What rankles them is that FERC has invested CNYOG with the power of eminent domain, taking away their bargaining power.

"Once the government becomes involved, this is what happens. Because you lose that leverage," said Amy Gardner, who, with her husband, faces condemnation of part of their 175-acre parcel in Sullivan County.

The Gardners say CNYOG offered less than a third of the amount that another pipeline company had previously paid them to install a gathering line on their land. The difference? Gathering lines ? smaller pipelines that take gas from the wellhead to a transmission line or processing facility ? are not regulated by the federal government and companies that operate them don't have condemnation power.

Amy Gardner said a company representative who made them the lowball offer told them to "take it or leave it."

"There's no negotiating with this company. They come and they tell you what they're going to do. They're telling you what they're going to pay. And they're counting on the government to enforce it," Gardner said in a recent interview at the Sullivan County Courthouse, where a judge has scheduled a mid-February hearing on the landowners' concerns.

Amounts offered by CNYOG range from a few hundred dollars to tens of thousands of dollars, depending on the amount of property taken. Court papers filed by CNYOG in late December say it valued damages at 37 condemned properties in Sullivan County at $310,900.

The pipeline has been controversial since it was first proposed two years ago.

FERC, which considers all applications for new interstate pipelines, received 22,000 comments on the MARC 1 project, with many expressing concern about environmental and safety impacts. The Environmental Protection Agency also worried about potential damage to the forest ecosystem, noting the pipeline will cross dozens of pristine waterways in an area popular with hikers, hunters and fishermen.

FERC ultimately determined the pipeline would not significantly impact the environment and allowed it to proceed.

The commission was also supposed to consider whether there would be an "unneeded exercise" of eminent domain ? the often-contentious legal process by which the government, or a party such as a public utility, takes private property for public benefit.

Indeed, the commission said last year its approval relied on the company's assertion that it was acquiring land "through negotiated agreements with landowners, thus minimizing the need" to condemn people's land.

In reality, the company had prepared condemnation papers for dozens of properties even before winning commission approval on Nov. 14. Within a few days, it began eminent domain proceedings against 74 of 152 property owners along the pipeline's route through the mountains of Bradford, Lycoming and Sullivan counties.

Deborah Goldberg, an attorney for the environmental group Earthjustice, said the large number of condemnations suggests that CNYOG "never made a serious effort to get negotiated agreements with the landowners that the landowners thought were fair." Earthjustice has intervened in the case and is challenging the pipeline's approval.

While most of the landowners receiving condemnation papers have since settled ? the company says private agreement has been reached with more than 80 percent of the landowners ? Goldberg suggested the pace of settlements has quickened because condemnation takes leverage away from the property owner.

The company insists it has met its obligation to negotiate. Its attorney, Michael Wright, said there were several "meet-in-the-middle cases" involving compromise.

"It's not like we were sitting silently until the FERC order and rushed to the courthouse," said Wright, who is based in Vestal, N.Y. "To say we did not attempt to negotiate in good faith is incorrect."

Wright acknowledged, however, that CNYOG told landowners that if they challenged the company in court, forcing it to incur legal expenses, then any deal on the table would be withdrawn.

Some landowners aren't interested in the money. They're more concerned about the pipeline's route.

CNYOG told Bob Swartz that it plans to cut a 50-foot-wide, 400-foot-long gash through an ancient stand of trees across the front of his property. When Swartz proposed an alternate route through an open field that would preserve his trees and views, the company said it wasn't interested and offered instead to pay him for the wood.

"That's not negotiation. It was their way or no way, and `we'll see you in court.' It's the little guys against Goliath," said Swartz, who has challenged the company in court.

Another landowner, Lisa Richlin, has appealed to federal regulators to force CNYOG to abandon plans for an access road along her property. Richlin said the road is at the bottom of a long hill and around a sharp bend where there have been many accidents, at least one of them fatal.

When Richlin pressed the company to use an alternate route a short distance away, she said, the company told her that would result in a six-month delay.

"I want them to go elsewhere. I don't want somebody to die because of stupidity," she said.

In a statement, the company said it has accommodated dozens of landowner requests for route changes, but can't do more because of "environmental, cultural and biological restrictions as well as other land use constraints."

Some landowners who didn't bother fighting the pipeline say the company still managed to leave a bad taste.

Linda Gavitt of Sonestown said she signed with CNYOG because she didn't feel it was worth it to hire a lawyer to fight for more money. Even as she signed the paperwork, she got a hint of the company's negotiating stance.

"They said that other people were holding out because they wanted more money," Gavitt recalled. "They said, `We're not paying more money because this is a federal line that's going to go through no matter what, and $2 a foot is what we pay.'"

(AP) ? Starbucks aims to open 50 outlets in India by year's end, through a 50-50 joint venture with Tata Global Beverages, the companies said Monday.

Tata Starbucks Ltd., as their venture is known, hopes to capitalize on the rising aspirations ? and fattening wallets ? of many Indians, who are eager to partake of the global latte life.

"What we are seeing is an evolution in lifestyles," said R.K. Krishnakumar, vice chairman of Tata Global Beverages. "In some ways the distinctions between the developed world and the developing world are blurring."

He said the partners would initially invest 4 billion rupees ($80 million), with the first outlet to open in Mumbai or New Delhi by September.

Long known as a nation of tea drinkers ? despite a rich tradition of coffee in the south ? India has embraced coffee house culture with a vengeance.

Last year, India had 1,600 cafes, up from just 700 in 2007, according to Technopak Advisors, which expects India's $170 million cafe market to grow 30 percent a year, adding up to 2,700 more outlets over the next five years.

"We're going to move as fast as possible in opening as many stores as we can so long as we are successful and so long as we are embraced by the Indian consumers," said John Culver, president of Starbucks China and Asia Pacific.

Unusually, the stores will be cobranded "Starbucks Coffee: A Tata Alliance."

The companies will also develop a tea for the Indian market under the Tata Tazo brand.

Last January, Starbucks signed an agreement with Tata Coffee, a unit of Tata Global Beverages, to source and roast coffee beans in India.

The alliance with Tata could help ease one of the main burdens for retailers in India: the high cost of real estate.

Krishnakumar said the joint venture would open outlets at properties owned by group companies, for example at the Taj chain of luxury hotels.

Culver said the company would also look at opening outlets in shopping malls, office parks, universities, airports and train stations.

The alliance will also help Tata Global Beverages expand its international footprint. All coffee beans for the cafes in India will be sourced from Tata Coffee, which also hopes to ramp up exports to regional Starbucks outlets, Krishnakumar said. He said other Tata Beverage brands, like Himalayan water, should also find their way into Starbucks outlets globally.

Culver said Starbucks did not consider trying to go it alone in India, despite the government's recent decision to allow foreign companies to operate single-brand retail outlets without a local partner. A storm of populist fury forced New Delhi to pull back a parallel proposal that would have allowed multi-brand retailers, like Wal-Mart, to open retail outlets with local partners.

"We never considered 51 percent," Culver said. "When we looked at the opportunity to enter India, understanding the complexities of the market and the uniqueness that is India, we wanted to find a local business partner."

Starbucks currently operates over 17,000 stores in 57 countries.

Its India venture will face competition from existing players like Cafe Coffee Day, which dominates the market.

Technopak founder Arvind Singhal said India's flourishing cafe culture has less to do with coffee than a social need for clean, safe gathering places for young and old alike, who often live in cramped quarters.

"India doesn't have too many places for people of any age to just go out," he said. "It's not about a coffee culture. It's a gathering place where people can sit and meet."

He added that Starbucks' entry, however much delayed, is likely to fan competition and speed the proliferation of coffee shops. It could also help boost flagging investor confidence in India. "It's almost like an endorsement that India's still a good story," he said.

A's remain open to signing Ramirez

OAKLAND, Calif. - The Oakland Athletics are open to signing slugger Manny Ramirez but the team is not actively pursuing the free agent.

That was the message Sunday from assistant general manager David Forst, who talked during A's Fanfest held at the Oakland Arena, next door to the Coliseum. A's owner Lew Wolff had suggested the move last week.

"We're open to it," Forst said. "We do have other things going on and we do expect other additions between now and opening day. We have never been in a situation where we had too many good players."

Ramirez applied for reinstatement to Major League Baseball last month. He was suspended for 100 games last year but the ban was trimmed to 50 because he sat out nearly all of last season. The suspension would start with the first game he is eligible to play after signing with a club.

"I think it would be fun," Wolff said. "This should be viewed on the basis of talent. Once he's served the penalty he should be free to do what he wants. I don't know what kind of shape he's in, though I hear he's in great shape."

Ramirez, who will be 40 on May 30, ranks 14th on the career list with 555 home runs. He was 1 for 17 (.059) in five games last season for Tampa Bay, which had signed him to a one-year deal worth $2.02 million. He retired from baseball rather than serve his longer suspension.

"I never actually met him," A's outfielder Josh Reddick said. "But to have a veteran hitter like Manny? That experience can only help us. We're a young team and I would look forward to a guy like that, a guy we can learn from."

Reddick was in the Red Sox organization when Ramirez was traded from Boston to the Los Angeles Dodgers in July 2008. He made his major league debut with the Red Sox exactly one year later.

Reddick said Ramirez left "an interesting" legacy behind.

NOTES: Wolff also expressed some impatience with Major League Baseball's study committee about the A's planned move to a new stadium site in San Jose. "We should be in it now instead of waiting for it," he said. "It's hard to be patient when it has hurt us everywhere. The only site available to us based on our analysis is the downtown site in San Jose." ... Wolff joked that his grandson no longer speaks to him because of the trade that sent Gio Gonzalez, his favorite player, to the Washington Nationals. ... Forst also denied reports that signing Jonny Gomes doomed OF prospects Michael Taylor and Chris Carter to the minors. "That is not true," he said. "There is a fifth outfield spot and the DH spot. They have an opportunity to be on the 25-man roster." ... A's manager Bob Melvin said he sees Gomes, Reddick, Seth Smith and Coco Crisp as part of a rotation for the outfield and included Collin Cowgill as a possible candidate for the fifth spot. ... The Fanfest drew over 7,000 people.

Spartacus, Episode 1: The Things That Made Us Go "Ew!" (omg!)

Run! Spartacus and his rebels are on the loose! In the Season 2 premiere of Spartacus: Vengeance, we see that no Roman is safe ? not even those spending their hard-earned coin at a brothel!

It's war between Spartacus' unwashed gang and the Romans, mainly Gaius Claudius Glaber and new pup Seppius, whom we foresee will be equally annoying and entertaining. Also, what's with the Folgers-ad-worthy banter and chemistry between him and his sister Seppia? Meanwhile, after the rebels go on a bordello killing spree, Crixus learns that his love Naevia is being sold from dominus to dominus as a sex slave. We also see Oenomaus running around incognito in a hooded robe, Lucretia has survived her abdomen wound but isn't quite sane, and Glaber is forcing his wife Ilythia to hang out in Capua while he seeks to defeat Spartacus.

Spartacus: What to expect in Season 2 (beyond the blood and bodies)

Let's check out this week's "Ew!" moments:

The Blood - Body count*: innumerable. In the opening battle, it was Agron brutally bashing one of the Roman's heads into a stone repeatedly that had us covering our eyes (and ears!). Later, Oenomaus makes short work with some men who attack him in an alley ? breaking one assailant's arm so that the bone sticks through the skin and then splitting another guy's abdomen from bottom to top, much as one would do with a human-sized haggis. There's plenty of naked bodies getting sliced and chopped up in the brothel massacre, but two rather disturbing highlights include one large Roman voyeur getting his throat impaled from behind and then Crixus using a ruthless interrogation tactic: wiggling his finger around in the slaver Trebius' fresh sword wound. Ouch!

The Bodies - Total scenes: 2.5. There's minor nudity scattered throughout the episode, and Ilythia gets hot and bothered flashing back to her masked tryst with Spartacus, while in reality, Spartacus is having unmasked relations with Mira. But really, this episode is all about the unique tour of the whorehouse, in which we see ladies and gents alike being manhandled and abused. Although there's plenty of sex, it's not really sexy considering these slaves can't fight back and Spartacus' men are splashing blood and entrails everywhere.

Best Line of the Week: From one of Spartacus' men: "You had me at whores."

*It should be noted that we may have to dispense with the body count this season now that it's open season on Romans and freed slaves alike. "I tried to [keep track] this season," series star Liam McIntyre told TVGuide.com in early January, "but because they're not in an arena where it's nice and tidy one-on-one, it's just ridiculously massive."

Some DODDS sports events in Italy postponed due to strike

AVIANO AIR BASE, Italy ? A nationwide truck strike that has resulted in highway closures and concerns of fuel shortages at gasoline stations also led DODDS-Europe to postpone some sports competitions scheduled in Italy over the weekend.

High school basketball games involving Aviano vs. Marymount International and Vicenza vs. American Overseas School of Rome scheduled for this weekend have been postponed, and Naples? contest with Florence International also scheduled for this weekend has been canceled, according to DODDS-Europe Athletic Director Karen Seadore. Games between American School of Milan and Sigonella are still scheduled for the coming weekend, she said.

A wrestling meet Saturday at Aviano will continue without half its scheduled participants, she said. Vilseck, Germany; Naples; AOSR; and Sigonella are not sending wrestlers. However, Vicenza; Black Forest Academy in Kandern, Germany; and a small contingent from Rota, Spain, still planto attend. Vilseck will now wrestle at Heidelberg on Saturday.

Truckers began their strike Monday in protest over rising fuel prices and high road tolls. It is supposed to end Friday. Since American high school basketball matchups are Friday-Saturday affairs and some wrestling squads would be traveling on Fridays, the cancelations made sense, Seadore said.

?Obviously, we do not want our kids to be in buses and stranded on the autostrada,? she said.

Vilseck canceled after being told that the Brenner Pass, one of the main routes connecting Italy with Austria and its neighbors to the north, had been blockaded by the striking truckers, Seadore said.

The strike has also led some Americans based in Italy to take precautions. Aviano Air Base and other U.S. installations have tried to keep servicemembers updated on local conditions.

Senior Airman Creighton Daetwyler, filling his car Thursday afternoon, brought along a 19-gallon container to fill.

He said the strike ?hasn?t impacted me yet, and I?m hoping with this container it won?t.?

Annette Fornier, a public affairs officer for U.S. Army Garrison Vicenza, said there was ?no indication? of gas shortages outside the base. But she said soldiers have been advised to keep their tanks at least half full.

Ajdezi Safet, who works at the Agip station where Daetwyler was filling up in Aviano, said his station should have gasoline through the weekend, but also recommended that drivers not let their tanks get close to empty.

A message posted on the NSA Naples Facebook page Thursday stated, in part: ?We are hearing plenty of reports that many gas stations have run out of unleaded fuel again.?

A report filed by ANSA, the Italian news service, said the strike was continuing Thursday despite some concessions by Italy?s government.

Citizen Scientists Study Whale Songs: Years of Work Done in Months

In November 2011, Scientific American, Zooniverse and a team of research partners launched the Web site Whale.FM, a citizen-science project devoted to cataloging the calls made by Pilot whales and Killer whales (Orcas), both of which are actually dolphin species. Different whale families have their own dialects and closely related families share calls. Underwater microphones, called hydrophones, typically attached by suction cups to the whales, record the haunting and lovely sounds. Cataloging calls is a step in learning more about the communication of these magnificent marine mammals.

So far, more than 5,000 Whale.FM visitors (including yours truly) have matched a total of more than 100,000 calls. The task is simple and fun?my daughters (ages 11 and 15) like to match calls with me. (The 11-year-old is pretty good at imitating the calls herself.) How it works: You listen to a call and see a spectrogram, a visualization of the sounds. Then you listen to several others that are displayed on the screen and see if you can select a match.

A question that has come up often about citizen-science projects is, How accurate are the data? Our friends at Zooniverse just did a spot check, using a subset of 300 of the calls. As Robert Simpson of Zooniverse put it in a note, ?We?ve compared their call categories to the (very!) preliminary results from Whale FM and it seems that the users are picking out good matches that tally with those of professionals.??? They located 28 subset-to-subset call pairings. A total of 25 of these were matched with calls from the same call category, as defined by professional scientists. Even more exciting, there were more than 350 pairings with calls outside of the 300-call subset?which is an important reason to do Whale.FM.

Scientists identify protein that contributes to symptoms of Parkinson's disease

ScienceDaily (Jan. 25, 2012) ? Scientists at the Gladstone Institutes, an independent and nonprofit biomedical-research organization, have identified a protein that exacerbates symptoms of Parkinson's disease -- a discovery that could one day lead to new treatments for people who suffer from this devastating neurodegenerative illness.

In a paper being published online in Neuron, Gladstone Investigator Anatol Kreitzer, PhD, and Talia Lerner, PhD, who worked at Gladstone while completing her graduate studies at the University of California, San Francisco (UCSF), describe how a protein called RGS4 normally helps regulate the activity of neurons in the striatum -- the part of the brain that controls movement. But in experimental models of Parkinson's disease, RGS4 does the opposite by actually contributing to problems with motor control. The result is a deterioration of movement and motor coordination, which are the hallmark symptoms of Parkinson's. More than 10 million people suffer from Parkinson's worldwide, including the boxer Muhammad Ali and the actor Michael J. Fox.

Scientists have long known that a drop in dopamine -- an important chemical in the brain -- is associated with Parkinson's. And for decades patients have taken a drug called Levodopa to boost the brain's dopamine levels. Unfortunately, however, Levodopa's efficacy begins to fade as the disease progresses. So scientists have begun looking for other targets for which they can develop new therapeutic strategies.

"About 60,000 Americans are diagnosed with Parkinson's annually, and dopamine-based therapies often do not provide a long-term solution," said Dr. Kreitzer, who is also an assistant professor of physiology and neurology at UCSF, with which Gladstone is affiliated. "Our discovery that RGS4 may play a role in the development of Parkinson's symptoms, helps us lay the groundwork for a new therapeutic strategy -- independent of dopamine."

Drs. Kreitzer and Lerner found that RGS4 is required for dopamine to regulate brain circuits during learning. But when dopamine levels drop dramatically, as in Parkinson's, RGS4 becomes overactive and disrupts these circuits -- thereby leading to Parkinson's symptoms. Therefore, they tested whether removing RGS4 could prevent these symptoms.

Drs. Kreitzer and Lerner treated mice lacking RGS4 with a chemical that lowers dopamine levels, mimicking the effects of Parkinson's. They then monitored the mice's motor skills -- including their ability to move freely in an open arena and traverse a balance beam -- and compared them to Parkinson's mice in which RGS4 remained intact.

As expected, Parkinson's mice with RGS4 intact exhibited major problems with movement. They lacked coordination and often remained frozen in place for long periods of time. When attempting to cross the balance beam, many had repeated slips and falls, while others could not even attempt the task.

But Parkinson's mice without RGS4 performed fluid, coordinated movements with no major problems, even though they also had lower dopamine levels. The vast majority crossed the balance beam without any missteps. Many of the physical traces of Parkinson's had disappeared.

"By discovering how the removal of RGS4 affects brain circuitry at the molecular level, we gained a deeper understanding of the protein's role -- both normally and in Parkinson's disease," said Dr. Lerner. "We've also shed light on a previously unknown mechanism by which the dopamine depletion causes the symptoms of Parkinson's disease. We are optimistic that our work could pave the way for a much-needed alternative to Levodopa -- such as a drug that has the ability to inactivate RGS4 in Parkinson's patients."

Funding for this research came from a variety of sources, including the National Institutes of Health, the Pew Biomedical Scholars Program, the W.M. Keck Foundation and the McKnight Foundation.

Rabbi Ammiel Hirsch: Turning Enemies Into Friends In Israel and the Palestinian Territories

In early Jan. 15 senior rabbis, ministers and imams traveled together to Israel and the Palestinian territories. We are from among New York City's leading religious institutions. Collectively, our houses of worship are home to tens of thousands of prominent New Yorkers.

Anyone who appreciates the hectic schedules and unique demands upon congregational clergy realizes that it is no small matter to bring 15 spiritual leaders together for five days. So why did we leave our congregations for a week? Why did our congregants insist that we go and even pay for our mission?

In the post 9/11 world, religious rapprochement is no longer a luxury; it is a necessity. To ignore dialogue is to invite destruction. If we do not find ways to live together in dignity we will die together in agony. Religious moderates must build new bridges of coexistence or religious extremists will burn the last bridges of peace.

Our presence in the Middle East was intended to broadcast that we can live together, work together, travel together, dream together and build together. In a world awash in religious conflict, we wish to model a different way: the way of coexistence, respect and peace.

It was a tough trip. We did not paper over our differences. We visited the heart of the conflict. There were moments of despair. We met with presidents, prime ministers, members of parliament and mayors on both sides of the Israeli-Palestinian divide. We met with priests, imams and rabbis. We met with journalists, academics, students, villagers and farmers.

Daily headlines do not begin to tell the story. None of the people we met -- not one -- believed that the Middle East is closer to peace today than ten years ago. If this is the truth, we need to hear it. Progress rests upon the solid rock of reality, not the shifting sands of fantasy.

Despite it all, many of us returned to New York guardedly optimistic. None of the people we met -- not one -- felt that the status quo was sustainable. Everyone understood that a way must be found to break out of the suffocating reality. There is broad agreement that the present is not working and that a new future must be forged.

People of faith have a unique role to play. Both Israeli President Shimon Peres and Palestinian Prime Minister Salam Fayyad urged us to engage. Both of them emphasized that religion could be a source of enormous support as the politicians seek a political solution. We can help to create a context that is conducive to peace.

Religion specializes in hope. We are good at articulating our common humanity and giving voice to the better angels of our nature. We were also cautioned that if we do not step up the forces of religious intolerance will continue to drag the rest of us towards war. Our era has placed a sacred obligation on the forces and figures of religious moderation to speak out and act out.

There are many good people working to build bridges. In Haifa we met Christians, Muslims and Jews who have built a true house of coexistence. In Tel Aviv we met doctors, nurses and hospital staff who treated illness without regard to race, religion or creed. Even on the Gaza border, in Israeli towns that were fired upon in a barrage of missiles, there were people who were reaching out to the other side.

Peace is made piece by piece, from the bottom up. Progress is advanced day by day, person by person, each laboring in their own corner of the universe, connecting with others who together create an irresistible force. We should connect with those people and strengthen their hand. This daily labor is heroic work.

Jewish sages ask: Who is a hero? They respond: He who turns an enemy into a friend.

This is our task: person by person to help turn enemies into friends.

Giffords says farewell to Tucson constituents (AP)

TUCSON, Ariz. ? On a bittersweet day for Rep. Gabrielle Giffords, the outgoing congresswoman spent her final hours in Tucson as the city's U.S. representative, finishing the meeting she started on the morning she was shot and bidding farewell to constituents who supported her through a long recovery.

It may not be the end, though. The woman whose improbable recovery captivated the nation promised, "I will return."

Giffords spent time Monday at her office with other survivors of the shooting rampage that killed six people and injured 13. She hugged and talked with survivors, including Suzi Hileman, who was shot three times while trying to save her young friend and neighbor, 9-year-old Christina-Taylor Green. The little girl died from a gunshot wound to the chest.

"The last time I did this I had Christina's hand," Hileman said. "It was something that was hanging out there, and now it's not."

Others who met with Giffords included Pat Maisch, who was hailed as a hero for wrestling a gun magazine from the shooter that day, and Daniel Hernandez, Giffords' intern at the time who helped save her life by trying to stop her bleeding until an ambulance arrived.

"It was very touching," said Maisch, who was not hurt in the attack. "I thanked her for her service, wished her well, and she just looked beautiful."

Giffords announced Sunday that she would resign from Congress this week to focus on her recovery. Maisch was sad to think that Giffords would no longer be her congresswoman.

"But I want her to do what's best for her," she said. "She's got to take care of herself."

However, an upbeat Giffords hinted that her departure from public life might be temporary. In a message sent on Twitter, she said: "I will return & we will work together for Arizona & this great country."

In her last act in Tucson as a congresswoman, the Democrat visited one of her favorite charities, the Community Food Bank of Southern Arizona.

The food bank established the Gabrielle Giffords Family Assistance Center with $215,000 it received in the wake of the shooting. Giffords' husband and former astronaut Mark Kelly told people who wanted to help Giffords after the shooting that the best way to do so was to donate to one of her favorite charities.

The center has helped 900 families get on food stamps in the last year and offered guidance to needy families seeking assistance with housing, insurance, clothing and other basic needs.

"It's a wonderful thing that she gets to come here and see the center we built," said Bill Carnegie, the food bank's CEO. "But it's also her exit from Congress. I'm concerned about the future."

Giffords' aides had to yell at TV cameramen and reporters who surrounded the congresswoman as she arrived, telling them to back up. Giffords didn't bat an eye and walked with confidence through the crowd and into the building, where she promptly hugged Carnegie and others.

When she saw the center that is named in her honor, she said "Wow" and "Awesome."

When one woman told Giffords, "I love your new hairstyle," she beamed and responded with "Thank you."

Giffords did not address reporters at the center and planned to head to the airport right after her visit. She was expected in Washington on Tuesday for President Barack Obama's State of the Union address.

In her announcement Sunday, Giffords said that by stepping down, she was doing what is best for Arizona.

"I don't remember much from that horrible day, but I will never forget the trust you placed in me to be your voice," she said in a video posted online.

The video showed a close-up of Giffords gazing directly at the camera and speaking in a voice that was both firm and halting.

"I have more work to do on my recovery," the congresswoman said at the end of the two-minute message, appearing to strain to communicate.

C.J. Karamargin, who was Giffords' spokesman until recently, said he can only imagine what she is feeling as she steps down.

"But Gabby would never want to do a job unless she could give everything to it," he said.

"The news of her stepping down was almost more emotional than this time last year because then, she had survived and had a positive prognosis. Now we've got this pause, this comma, in her career ... and she won't be back anytime soon."

Giffords was shot in the head at point-blank range as she was meeting with constituents outside a grocery store. Her recovery progressed to the point that she was able to walk into the House chamber last August to cast a vote.

Giffords' resignation set up a free-for-all in a competitive district.

She could have stayed in office for another year even without seeking re-election, but her decision to resign scrambles the political landscape.

Arizona must hold a special primary and general election to find someone to finish out her remaining months in office. That will probably happen in the spring or early summer. Then voters will elect someone in November for a full two-year term.

Giffords would have been heavily favored to win again.

She was elected to her third term just two months before she was shot, winning by only about 1 percent over a tea party Republican. But she gained immense public support during her recovery.

Among those mentioned as potential candidates were several Republican and Democratic state lawmakers and the name of Giffords' husband, Mark Kelly, although he has publicly quashed such speculation.

A state Democratic party official who met with Giffords on Sunday also suggested that she could return to politics.

Jim Woodbrey, a senior vice chairman of the state party, said Giffords strongly implied at a meeting that she would seek office again someday. He said the decision to resign came after much thought.

"It was Gabby's individual decision, and she was not in any condition to make that decision five months ago," he said. "So I think waiting so that she could make an informed decision on her own was the right thing to do."

Samsung SSD 830 Series (256GB)


If 2011 wasn't the year that solid-state drives (SSDs) went mainstream, it was a year they delivered newly groundbreaking performance. First came the incredibly fast 240GB OCZ Vertex 3, which was followed by its slightly less impressive 120GB version. Those looking for a lower-capacity SSD had at least one outstanding choice, the 128GB Samsung SSD 830 Series. But when Samsung's drives hit higher capacities, how well do they stand up against OCZ's? Pretty well, at least with regards to the 256GB version ($429.99 list)?though it doesn't come out on top in every situation.

Even so, it has all the features you have a right to expect from a top SSD contender at the beginning of 2012, starting with 6Gbps SATA III. (Samsung's 2010 debut consumer model, the SSD 470 Series, only used 3Gbps SATA II.) More impressively, this 2.5-inch-form-factor drive (which measures only 7mm in height?on the short side for an SSD) is Samsung all the way down, from its stylish and shiny black brushed-metal frame to its three-core controller to the DRAM to the 20nm MLC toggle DDR NAND flash memory itself. Samsung even claims that the drive's wear-leveling and garbage collection technologies are proprietary (though traditional TRIM is supported). You can expect to get about 238GB of usable space from the drive (the remaining gigabytes are dedicated to overprovisioning), and it's covered by a three-year warranty. Other nice inclusions are discs containing the full version of Norton Ghost and Samsung's SSD Magician software for performing tasks like optimizing performance (via garbage collection) and updating the drive's firmware and, as of early January 2012, a free download code for Batman: Arkham City.

Performance was robust as well, with the Samsung drive constantly trading top scores and times with the 240GB Vertex 3. What drive came out ahead and on which task depended on the particular application. On our AS SSD benchmark, OCZ's drive generally did better with reads and Samsung's with writes, and we witnessed something similar on the ATTO Disk Benchmark?up to a point. From 0.5KB to 2KB, OCZ owned the reads and the Samsung writes; at 4KB the two flipped and continued alternating wins straight down the line through 512KB. With results upwards of 546MBps in 128KB, 256KB, and 512KB sequential reads, the Samsung drive even surpassed its own stated performance rating of 520MBps?an impressive feat. (For the record, the Samsung drive also promises up to 400MBps sequential write speeds, and routinely performed above that rating, too.)

It was after that, however, that the Samsung's limitations began to show. The OCZ took the rest of the rest of the ATTO tests?both write and read?up to 8MB, all of the CrystalDiskMark tests except Sequential and 4KB QD32 reads, and all of the PCMark 7 storage trials. The biggest discrepancy we noticed was on CrystalDiskMark's 4KB QD32 Write test: The OCZ delivered a result of 252MBps, whereas the Samsung drive could only muster up 147.4MBps. Combined with the ATTO results, this shows that, when you're more intensively moving larger amounts of data, the 256GB Samsung drive can't quite keep up with the competition.

Based on what we observed, the Samsung SSD 830 Series isn't quite able to wrest our Editors' Choice title away from the 240GB OCZ Vertex 3 (which is also priced at $399.99 list, $30 less than the Samsung)?but in more standard everyday applications it's essentially a neck-and-neck race. Our standard position in situations like this is that, all else being equal, when you're paying this much money for this (relatively) little storage space, you want the fastest speeds possible, and you get those with the OCZ drive. Nevertheless, Samsung's drive is an attractive, consistent performer ideal for slightly lower-level applications, and its larger amount of storage space and free software may help cushion the blow of the marginally slower transfer rates that just keep the SSD 830 Series from taking the top prize.

We saw tons of interesting Bluetooth gamepads that can be added to iPhones at the Consumer Electronics Show 2012 in Las Vegas this month. As well, other alternatives like the iPad arcade cabinet iCade or the Fling Joystick line for the iPhone and iPadallow you to add real controls to your device. For many gamers, the right controls can mean becoming a better player.

4. Sound matters

Though the built-in speakers on the iPhone and iPad aren?t the greatest, sound design in iOS games can often be very, very good. Titles such as Dark Meadow, Dead Space and N.O.V.A. 2 use sound to make the experience more immersive, the game spookier, and the combat more intense. Some games have console video game-caliber audio design and create a stereo experience that will have you turning left and right in the game to look for the sources of sounds. Just understand that you lose that sense of depth and immersion when you don?t have the right equipment. The ear buds that come with your iPhone or iPad will do in a pinch, but it?s recommended you get ahold of a comfortable, better-quality pair of headphones to really allow games like Groove Coaster or the Tap Tap Revenge titles reach their full potential.

5. Make some friends

A good way to start: Pick your favorite Game Center titles and try to place on their leaderboards. Cruise the boards for players near your rank and shoot them a message and a challenge, because just about every game is a lot more fun when you have a little competition. U.S. gives church groups a year on birth control rule (Reuters)

WASHINGTON (Reuters) ? The Obama administration on Friday ruled that religiously affiliated nonprofit organizations, including hospitals and universities, will have to offer birth-control coverage to women employees but gave the organizations an extra year to comply.

In a decision expected to draw opposition from religious conservatives, the Department of Health and Human Services issued a final rule requiring affiliated groups to provide a broad range of services, from implanted contraceptive devices to the morning-after pill. Many do not at present.

The government's decision does not apply to churches, synagogues, mosques, temples and some religiously-affiliated elementary and secondary schools, which remain exempt.

But it comes as a blow to the interests of some religious authorities.

When HHS first announced plans to adopt the birth control rule last August, it stirred protests from religious groups including the Roman Catholic Church that wanted the exemption to apply to a broader category of organizations. The Catholic Church holds contraception to be sinful.

The change, intended to reduce unwanted pregnancies and abortions, is part of President Barack Obama's healthcare overhaul, his signature domestic policy achievement, which is facing major challenges from the Supreme Court and Republicans this year as the president seeks re-election.

"This decision was made after very careful consideration, including the important concerns some have raised about religious liberty," Health and Human Services Secretary Kathleen Sebelius said in a statement.

"This proposal strikes the appropriate balance between respecting religious freedom and increasing access to important preventive services."

Religious-affiliated nonprofit organizations, many of which currently do not offer birth control coverage, have until August 1, 2013, to comply with the new rule. Other employers must begin covering the services from August 1, 2012.

No time to play nice for US women's soccer team

VANCOUVER, British Columbia - It's hard not to look like a bully when the final score is 14-0. The U.S. women's soccer team had never beaten anyone that badly, not even in the days of Mia Hamm, Michelle Akers, Julie Foudy and Brandi Chastain.

But this is no time for sympathy. This wasn't a friendly; this was the first game of qualifying for the London Olympics. The non-competitive blowout of the Dominican Republic on Friday night left no doubt whatsoever that the Americans have banned complacency from the roster.

"We want to qualify for the Olympics," coach Pia Sundhage said. "And that's what comes back all the time. This is important. We care every single game and every single goal. And if we can keep that and not take anything for granted ? like we almost did when we tried to qualify for the World Cup ? if we can keep that feeling, we will win the next game."

The shock to the system was a qualifying loss to Mexico in late 2010 that threw a huge detour into the Americans' route to last year's World Cup. It remains the only defeat for the U.S. team in 34 games of Olympic or World Cup qualifying.

So when the score was 7-0 at halftime Friday night, forward Abby Wambach wasn't satisfied. She's concerned the Americans might need a win a tiebreaker based on goal differential to get a more favorable matchup in the semifinals. She told her teammates to score more goals.

"It's not easy to beat a team 14-0, quite frankly," Wambach said. "But at the end of the day we needed to make sure and secure the goal differential. That's what's been on my mind all night."

It would seem the mission is accomplished. Soccer teams just don't win games by two touchdowns, not at this level. The previous record tally for the U.S. team was set back in 1991, with 12-0 wins over Mexico and Martinique in a pair of World Cup qualifiers.

But the BC Place crowd couldn't help but feel sorry for the Dominicans. They started cheering any accomplishment, no matter how small, by the underdogs ranked 88th in the world. The Americans could only do such much: You can't pull all the starters in a sport that only allows three substitutes. Besides, Sundhage wants her players honing their technical skills for the tougher games that lie ahead.

"You can literally put your foot on the ball and stop playing," Wambach said. "Or respect the game, respect your opponents and keep playing soccer. It's a hard balance. We don't want to put Dominican in a position where they feel bad about themselves. We want them to know that they have an opportunity to learn something as well. It's not easy."

There are eight teams in Vancouver vying for two CONCACAF berths for the London Games, but only four arrived in Canada with any sort of a realistic shot. Four games into the tournament, the score between the haves and have-nots was 27-0 ? the United States, Canada, Mexico and Costa Rica were unblemished against Haiti, Cuba, Guatemala and the Dominican Republic.

Essentially, the tournament serves to see whether Mexico and Costa Rica can swipe one or both Olympic berths favored to go to the U.S. and Canada. Sundhage, therefore, was asked whether the field is too big, given the embarrassment the Dominicans had just endured.

"No. I think it's a wonderful experience for all of us to be here," said Sundhage, who went on cite the value in giving developing teams more chances to travel and play games in high-profile tournaments.

Goalkeeper Hope Solo said she hopes the experience will enlighten the Dominicans so that they will "continue to put money into their federation and continue to grow women's soccer."

The Americans, meanwhile, spent Saturday preparing for what should be another overmatched opponent. They play 85th-ranked Guatemala on Sunday before wrapping up group play with a marquee game against Mexico on Tuesday.

But even one-sided games have their perils. Starting right back Ali Krieger tore the ACL and MCL in her right knee in the first half and is likely to miss the Olympics. The 27-year-old Krieger played every minute of all six games at last year's World Cup.

Losing Krieger will hurt, but the U.S. has one of the few teams deep enough to absorb such a blow. When Krieger left the game, she was replaced by Heather Mitts ? who earned her 119th international cap and would be a regular starter for most any other team in the world.

"It's really hard to make the team right now," Sundhage said. "We have so many good players. I think this is the best ? if you look at individuals ? the best team I've ever had since (becoming U.S. coach in) 2008."

Billionaire donates for Washington Monument repairs

A billionaire history buff has stepped forward to donate the $7.5 million matching gift that's needed to start repairing cracks near the top of the Washington Monument from last summer's East Coast earthquake.

Businessman David Rubenstein told The Associated Press he was inspired to help fund the repairs to the 555-foot obelisk when it became clear how severely damaged it was by a 5.8-magnitude quake on Aug. 23. The monument received about 1 million visitors a year before the famous landmark was closed to the public after the quake.

The Park Service hopes to have a contractor begin work by the end of August. The repair work is expected to take a year to complete, likely keeping the monument closed for two years.

Largest gift
Congress allocated $7.5 million in December on the condition that private donations would match that amount. The National Park Service and nonprofit Trust for the National Mall are expected to announce Rubenstein's gift Thursday morning. It will be the largest gift to the nonprofit group, which aims to raise $350 million to restore the mall's grounds and facilities.

The combined $15 million in public and private funds is expected to cover the cost of repairing damage directly caused by the quake, said National Park Service spokeswoman Carol Johnson. Repairing water damage will cost more, as would a seismic study or reinforcements to strengthen the obelisk against future earthquakes, she said.

Rubenstein, a co-founder of The Carlyle Group, began building the private equity firm's business in Washington and said he wanted to restore a symbol of the nation and hasten repairs to reopen the landmark.

"This Washington Monument is probably one of the most recognizable buildings in the United States next to the Capitol and the Empire State Building," he said. "It could use a little repair work, and I wanted people to get to see it as soon as possible."

Experts have noted the monument needs more than just a little repair work, though it has been deemed structurally sound.

Extensive repairs needed
The August quake was centered some 40 miles west of Richmond, Va., and felt from Canada to Georgia. It damaged the Washington National Cathedral, where pieces of mortar rained down from its vaulted ceiling. At the Washington Monument, panicked visitors fled down flights of stairs on the day of the big shake, but there were no known deaths or serious injuries in the region.

The earthquake caused numerous cracks to form in the obelisk, which was the tallest man-made structure in the world when it was completed in 1884.

Surveillance video taken the day of the quake and later released by the park service showed the spire shaking violently. Daylight could be seen through some of the cracks, the largest of which was reported to be at least 4 feet long and about an inch wide.

A report in December recommended extensive repairs and reinforcements to preserve the spire. It said some marble panels were cracked all the way through near the top portion of the monument. Cracks near its peak also have left the monument vulnerable to water damage from rain, engineers noted.

Last fall, daredevil engineers on a "difficult access team" rappelled from the top to conduct a visual inspection of the exterior of the obelisk.

Officials said it's unclear whether the work will require scaffolding to be built around the monument, similar to what was erected during a restoration project from 1999 to 2001.

'A true patriot'
Caroline Cunningham, president of the Trust for the National Mall, called Rubenstein "a true patriot" and said his gift "demonstrates how much people care about this space." She said it should serve as an example for other philanthropists.

There has long been talk of sprucing up the mall at the heart of the nation's capital.

A design competition is under way to develop ways to improve the mall, including the Washington Monument grounds. Finalists will be chosen in May, and the group will seek funding for each project. The nonprofit group has targeted parts of the mall that are run down from over use and neglect as a focus for its restoration efforts.

Rubenstein has made large gifts in recent years to Washington's cultural institutions including the Smithsonian Institution, the National Archives, the Library of Congress and the Kennedy Center.

The monument, which he visited recently, was built with private $1 donations eventually totaling over $1 million, Rubenstein said. Construction began in 1848, but funds ran out during the Civil War when the monument was left as an embarrassing stump for years. It was finally completed in 1884 and was the world's tallest man-made structure until it was eclipsed by the Eiffel Tower. It remains the tallest structure in Washington.

Rubenstein owns a copy of the Magna Carta, among other historical documents, and reveres George Washington.

"I like to remind people about American history," Rubenstein said. "George Washington is an incredible figure. When he was the head of the Revolutionary War Army, he could have stayed on as really the head of the government when we won the Revolutionary War, but he put down his arms."
